Former estate agent Vicki Momberg, who was convicted of crimen injuria, was refused leave to appeal the sentence on Wednesday. Momberg faces a two year prison term after a video of her going on a racist tirade went viral. She appeared in the  Randburg Magistrate’s Court in Johannesburg today and was refused leave to appeal the sentence and conviction.

Momberg was found guilt on four counts of crimen injuria, after calling a police officer the k-word 48 times. The police officer in question came to her aid following an alleged smash-and-grab incident which in Northriding, Johannesburg.

Momberg’s prison sentence is the first of its kind in South Africa. Last week her lawyers argued that her sentence was too harsh and punitive, because she was in an emotional state at the time of her racist tirade and did not have criminal intent.
