A Bellville magistrate has amended the bail conditions of Sameemah Jacobs, requiring her to remove her pardah and present her identity document when signing in at the Delft Police Station, reports Cape {town} Etc.
Jacobs was granted R4 000 bail on 28 July 2025 after police found newborn Mogamat Imaad Sharmar safe at her home two days after the alleged abduction on 28 June.
According to Cape Argus, Jacobs’ legal aid attorney told the court she wished to change her signing station from Kleinvlei to Delft. Jacobs also reportedly sought permission to enter Mitchells Plain to reclaim her belongings and to pursue eviction proceedings against alleged illegal occupants of her Searidge Park home.

The state opposed the request, arguing that Jacobs had not provided credible documentation and that the property was jointly registered, which weighed against granting her access. The court consequently denied her request to visit Mitchells Plain.
Civil rights organisation Action Society has called for the case to be treated with the utmost seriousness. Kaylynn Palm, head of the organisation’s Action Centre, said, ‘Clearly the accused carefully planned and executed the abduction. The court must ensure that the bail conditions reflect the seriousness of this crime and the risk posed by the accused.’
Court documents and reports indicate that Jacobs allegedly used multiple SIM cards and false names to establish contact with the baby’s mother before the incident.
Community members remain concerned as investigators continue to pursue forensic and cellphone analyses. Magistrate Gcobani Ndaleni postponed the matter to 22 January 2026 as police continue building their case.
