Zandile Mafe’s legal team challenged a court ruling committing him to Valkenberg Psychiatric Hospital for observation.
This comes after a document from a district surgeon was produced which showed that the alleged Parliament arsonist was suffering from paranoid schizophrenia.
However, according to News24, the Western Cape High Court declared Mafe’s referral to Valkenberg Hospital unlawful, and said that he was reportedly not questioned before being referred for psychiatric observation by the Cape Town Magistrate’s Court.
Judge President John Hlophe said: “The further detention of Mr Mafe in Valkenberg is unlawful and should come to an end with immediate effect.”
Judge Hlophe went on to say that Mafe should be released on Wednesday morning to be placed in a normal corrections facility and taken out of Valkenberg.
49-year-old Mafe faces five charges including arson, a charge of terrorism as well as housebreaking with the intent to steal in relation to the incident.
