The Congolese man accused of stabbing and killing a US citizen with a kitchen knife in Green Point appeared in Cape Town Magistrates’ Court for the first time on Monday.

Gedeon Tshimowa (27), allegedly had an argument with Phillips Olagoke Allen-Barake (22), in the kitchen of Atlantic Point backpackers on Friday morning, when the American citizen was fatally stabbed.
Tshimowa was arrested, and the court heard that he had been charged with both murder and escaping from custody.
The accused entered the dock on Monday. He did not speak.

His private attorney did the talking. He stated that his client had been in South Africa for 20 years and had the necessary documentation.
Tshimowa’s defence counsel also stated that he had no previous convictions, outstanding warrants, or pending cases.
He was arrested at his home, and the case was postponed until February 27 for bail information.
The charge sheet reads: ‘The accused is/are guilty of the crime of murder, on or about the 9th day of February 2024 and at Sea Point Backpackers, the accused did unlawfully and intentionally kill a male person.’
‘On the second charge the document states that the accused is/are guilty of the offence of contravening the provisions of Section 51(1) of the Criminal Procedure Act 51 of 1977 – escaping from custody.’
‘In that upon or about February 9 near or at Sea Point District/Regional Division of the Western Cape, the accused, after he had been lawfully arrested and before being lodged in a prison, police cell or lock-up did unlawfully and intentionally escape or attempt to escape from such custody.’
