Vodacom has been ordered to reassess the payment it owes to Kenneth Nkosana Mathe, the inventor of Please Call Me (PCM).

In a landmark ruling, the Gauteng Division of the High Court in Pretoria ruled that Mathe is entitled to 5% of the total voice revenue generated by Vodacom’s PCM product from March 2001 to March 2021.
According to Mybroadband’s summary, this means that Vodacom was ordered to Mathe between R28.99 billion and R55.37 billion.

As per the Supreme Court’s ruling, this includes revenue from prepaid, bundled and unbundled contract fees, and interconnect fees.
Mybroadband reports that Vodacom must determine an annual effective rate, ensuring it does not fall below the public ICASA effective rate. The court also provided a specific method for calculating Makate’s entitlement for return calls to PCM.

Furthermore, Mathe is entitled to the time value of money at a rate of 5% for each successive year owed by Vodacom. The court has given a one-month deadline for the determination, and both parties are responsible for their respective costs related to Constitutional Court negotiations.
